Istramagica, owned by Mirko Muermans, is an online accommodation agency based in Kaiserslautern/Germany. The accommodations offered by Istramagica are all private accommodations in Istria/Croatia.

  1. General/Contractual Conditions
    Istramagica acts as an intermediary between the owners of the accommodation and the clients. Istramagica is not a tour operator, the owner of the accommodation is also not a tour operator. The contracting parties are the owner of the accommodation and the client. The rental contract is concluded between the client and the owner of the accommodation, unless the owner objects within 24 hours by written confirmation from Istramagica. Istramagica is not responsible for any obligations arising from this contract. The Travel Act does not apply to the accommodation offered here.
  2. Tasks of the intermediary Istramagica
    Istramagica acts as an agent and advisor only. Istramagica arranges accommodation on behalf of the owner. The booking conditions will be communicated to the client.
  3. Liability
    Istramagica does not guarantee that the booking requested by the client will be made. There are no claims against Istramagica arising from the mediated contract between the customer and the accommodation company/organizer. Warranty claims due to defects as well as recourse claims of any other kind resulting from poor or non-fulfilment of the services booked with the accommodation provider must be asserted against the accommodation owner. If necessary, the accommodation owner is liable to the customer within the scope of its terms and conditions, which Istramagica can request upon special request. Insofar as Istramagica makes a recommendation, it is non-binding. Istramagica does not assume any liability for this. All services and information researched and requested for the customer shall be passed on to the customer by Istramagica as received from third parties without verification of the content. Istramagica is an agent of third party services and is only liable for the proper procurement of the service, and not for the service provision itself. Thus, Istramagica is not liable for service disruptions in connection with third-party services. 
  4. Booking procedure
    Based on the Customer's request to Istramagica to make the booking, the Customer will receive a booking confirmation by e-mail, which will include the terms and conditions (price, type of accommodation, method of payment, cancellation terms). The client confirms the booking and accepts the terms and conditions described at by making the required deposit. No later than 3 days after receiving the payment, the customer will receive the confirmation of payment and the required information about the booked accommodation (contact details: name of the owner, address, phone number).
  5. Costs
    Upon receipt of the booking confirmation, the required deposit is due to Istramagica's business account. The remaining payment will be made as stated in the booking confirmation. The respective payment and cancellation conditions can be found in the rental conditions of the respective accommodation, which are stated in the booking confirmation.
  6. Deposit/Remaining payment
    Upon receipt of the booking confirmation, a deposit of 15% is due within 10 days to Istramagica's business account. If the deposit is not paid within 10 working days, the apartment will be reported as available again in the reserved period. Therefore, no binding contract between the customer and the owner of the accommodation has been concluded. 
  7. Withdrawal, cancellation, rebooking
    Any withdrawal from the contract or cancellation of an accommodation booking must always be made in writing by the customer to Istramagica. Cancellation is possible free of charge up to 6 weeks before the date of arrival, but the deposit will not be refunded. After that, 80% of the rental price will be due if the apartment cannot be re-rented during the booked period. Deviations from this will be described in the rental conditions. For the safety of the customer, Istramagica recommends the conclusion of a travel cancellation insurance.
  8. Cancellation of the booking by Istramagica
    If Istramagica has to cancel an accommodation/event before the start of the trip for reasons of force majeure, the deposit already paid by the client will be refunded.
  9. Passport, visa and health requirements
    EU citizens need a passport or identity card valid for another three months to enter Croatia. Citizens of other countries and stateless persons should contact the relevant consulate. The customer is responsible for obtaining and carrying the necessary travel documents, any required vaccinations and complying with customs and foreign exchange regulations.
  10. Arrival and departure day/number of persons
    The arrival and departure day is Saturday, unless otherwise expressly agreed. The number of persons (adults and children) stated in the booking confirmation must be observed in any case. It may not be exceeded even by short-term accommodation of additional persons. Generally the arrival has to take place between 15:00 and 20:00 o'clock. If the landlord wishes a different arrival time, this will be communicated to the customer before departure. Outside the specified time, it is not guaranteed that someone will be available to hand over the keys. Time deviations on the day of arrival by the customer are to be communicated to the landlord for the booked accommodation in time. If the tenant does not arrive on the agreed date or does not report a late arrival, the tenant loses his right to the agreed accommodation. The obligation to pay remains unaffected. The apartment must be handed over on the day of departure in broom-clean condition , including cleaned dishes and removed garbage. 
  11. Security deposit
    A security deposit as stated in the property description or the booking confirmation is to be paid in cash to the owner on the spot when the accommodation is handed over. This will be refunded if no grossly negligent damage has occurred. 
  12. Use of the swimming pool
    If swimming pools are described in the description of the accommodation, please note the following: Swimming pools are usually only in operation from May to September and can be used at your own risk. Occasionally, due to the necessary cleaning of the pool may be required to impair.
  13. Pets
    The accommodation owner can refuse to accept a pet if the customer has not informed that he/she is bringing a pet on the trip or if the information given by the customer about the pet is different (especially the size of the dog) Pets are not allowed in the pool!  
  14. General information
    During the rental period, the tenant is liable for any damage caused to the rented property by him, his relatives, the pet he brought with him or by visitors. He is responsible for the house during the rental period, has to keep it in a neat and clean condition. The tenant is obliged to immediately report any damage caused by him during his rental period to the landlord or to compensate him. According to the law, a tourist tax is due in Croatia. This amounts to between 0,50 € and 1,40 € per person per day. This is paid on arrival on the spot. In Croatia every foreign guest is obliged to register within 24 hours after arrival. 
  15. Ancillary agreements
    All subsidiary agreements, additional agreements and amendments must be made in writing. Should individual provisions of these General Terms and Conditions be invalid or void, this shall not affect the validity of the remaining provisions.
  16. Place of jurisdiction
    The place of jurisdiction for legal actions against Istramagica is Kaiserslautern/Germany.
  17. Applicable Law
    The contracting parties agree that German law shall apply to all legal relationships arising from the mediation contract.
